Oh, I get it. This is the first sign that God is striking Scalia with dementia and he must retire. But in exchange, the Republicans will win the Senate in the midterms.

This seems to be all of a piece with previous Roberts court rulings in which conservatives make shit up and expect, as a matter of course, to be believed. (Think, particularly, about the whole concept of the primacy of states' sovereignty, which seems to exist only in their minds, insofar as they adhere more strongly to the Articles of Confederation than to the Constiution superseding that agreement.)Scalia just figured he could blow this one past the umps and they'd never notice. This was a tactical error, not a sign of dementia. Scalia has always been one to believe that the law means exactly what he says it means, and he can believe six, no, twelve impossible things before breakfast.
O will appoint another conservative, if he gets a chance. Possibly not a conservative with dementia but a conservative.
