And each one of these points on what is really "Judicial Activism" is backed up by fact. The conservatives on the Court are far more likely to overturn Congressional acts than liberal appointees.

A return to "substantive due process" would be fine with me if Hugo Black, William O. Douglas, Wiley B. Rutledge, Frank Murphy and Thurgood Marshall were still on the SCROTUS. Because they rejected it.
