So, when does the Administration declare this a win?

All part of their "secret" islamic/socialist agenda...doing nothing and letting Judges do their work for them?

A federal judge in California said Thursday that the U.S. military's ban on openly gay service members violates the Constitution, the most recent in a string of court rulings overturning restrictions on the rights of the country's gay men and lesbians.

U.S. District Judge Virginia A. Phillips said the government's "don't ask, don't tell" policy is a violation of due process and First Amendment rights. Instead of being necessary for military readiness, she said, the policy has a "direct and deleterious effect" on the armed services.

Profile in courage it isn't.

such a ray of light coming out of the federal courts. it's been findings like this that have helped ease the disappointment over this administration. and helped stem the impulse to throw up my hands in despair, give up and escape to canada.

no wonder republicans are intent on blocking new judges from being seated.

but then again, why isn't obama raising more of a stink about his nominees being blocked? he isn't even threatening recess appointments as a form of leverage.

cons didn't meekly and passively put up with bush nominees being blocked. republicans got incredible mileage out of being vocal in denouncing dems as obstructionists.

Ah, at least one judge has seen the light and let the shades be drawn.
Let their branch of govt bathe in sweet reason's light. vox
